Is there a law on outdoor residential lighting in the AP? If so, how do I find?
I have a neighbor who insists on using a projector that shines directly in my house. Light up my backyard, as the light of day. I asked him three times to remove it and replace with solar lights or find another alternative that have beenmet with resistance. I am hoping that there is a law to regulate this. There is no city ordinance yet. The zoning officer is aware of the situation. If PA is a law regarding it, I should be able to hold him to that. BTW - also gave a gift card from $ 20 to Lowes and some flashlights to make it easier for him to remedy it. I guess my next step would be legal action or a fence.
.. Ok have treated in several cities in relation to outdoor lighting, all cities that have tried, with very few exceptions, has a "lighting trespass" ordinance. Essentially, there are a maximum level of light, measured in candelas, which allows extended to a property line. In all cases I tried, violation of light has corresponded to commercial properties, but the ordinances do not distinguish between commercial and residential. If you live in an important area, there is a high probability that your city has an ordinance for the transgression of light. If so, you may file a complaint with the city and they have to respond. You can use a light meter that measures of candles, and most of the ordinances only allow 0.25fc at the property line. If you can not rent a meter, then you may have to find an electrician he has one. Considering that the full moon is about 1FC, this gives a good benchmark as to how much was spilled. You are the last resort a civil suit, the best chance to win is if you can prove that light your neighbor is actually aimed at his property. Otherwise, it is over and still could have a good case. Get on the city website, find the codes and ordinances, then locate the lighting ordinance. You can also call City Hall and an official request from the application code. He or she will tell you what lighting ordinances of the city has adopted. Ask specifically about requirements of the transgression of light, so the level of maximum transgression is (in candelas), and if they apply to residential.
